TERMS OF SERVICE/LIABILITY WAIVER

By scheduling our services, you confirm that you have read and comprehend our Terms of Service & Liability Waiver for services provided by Creative Enterprise Powerwashing, LLC, whom hereinafter is referred to as “CEP” or “The Service Provider”, and agree with the below. These Terms of Service and Liability Waiver are subject to change.  

 

GENERAL TERMS/CONDITIONS: CEP will provide all equipment & labor to complete the Scope of Work. A Certificate of Insurance is available upon request. Quoted prices are good for 30 days from the above date, after which values may be subject to change.

 

***PRIOR TO SERVICES PLEASE MOVE ITEMS:
SMALL ITEMS: This includes items such as clothing, furniture pillows, rugs, toys, pet bowls, door decorations, yard flags, potted plants, towels, floats, wind chimes, table décor, etc. – Please move these smaller items inside or away from washing area ahead of time. CEP will not be responsible for moving these small personal items or damages if left.

MEDIUM ITEMS: This includes items such as patio furniture (tables, chairs, side tables), small/lightweight grills, small potted plants, umbrellas, etc, – We can either work around these or please have them moved prior to scheduled services. If not moved, it could get very wet and will be exposed to our cleaning solutions. **We can move MEDIUM items for an additional fee – if you would like for us to move medium items of the way and return afterwards, please let us know ahead of time, so we can revise your quote. If we arrive and the area of wash is not ready, we will wash around items but please note they may be exposed to our cleaning solution and we are not liable for any damages.

LARGE/HEAVY ITEMS: This includes items that are 50lbs+ such as large potted plants, heavy grills, hottubs, etc – these items are not included for optional moving fees and will not be moved by CEP. Large/heavy items should be moved prior to scheduled services if you wish. If we arrive and the area of wash is not ready, we will wash around items but please note they may be exposed to our cleaning solution and we are not liable for any damages.

Scheduling:

1. Weather-Related Rescheduling 

1.1 We, CEP, are committed to providing high-quality pressure washing services to our clients. However, we understand that weather conditions can sometimes be unpredictable and adverse, which may affect our ability to perform the service as scheduled. 

1.2 In cases where weather conditions, such as heavy rain, thunderstorms, strong winds, extreme cold, or extreme heat, pose a safety risk to our team or could compromise the effectiveness of the pressure washing service, we reserve the right to reschedule the appointment. 

1.3 We will make every effort to monitor weather forecasts in advance to assess the suitability of the scheduled service date. If we determine that the weather conditions are not conducive to safe and effective pressure washing, we will promptly notify the client and propose an alternative date for the service. 

2. Client Communication

2.1 As part of our commitment to clear communication, we will contact the client as soon as we become aware of unfavorable weather conditions that may necessitate rescheduling. 

2.2 We will work collaboratively with the client to identify a mutually convenient alternative date and time for the pressure washing service. 

2.3 We encourage clients to provide accurate contact information to ensure efficient communication regarding any necessary rescheduling. 

3. Client Responsibilities 

3.1 Clients are encouraged to keep an eye on weather forecasts leading up to their scheduled pressure washing service to anticipate any potential issues related to weather conditions. 

3.2 If clients become aware of adverse weather conditions that may affect the scheduled service, we request that they promptly notify us to assess the situation and explore rescheduling options. 

4. Rescheduling Process 

4.1 When a decision to reschedule the service is made due to adverse weather conditions, both parties will work together to identify a new date and time that is suitable for the client and our team. 

4.2 We will make reasonable efforts to accommodate the customer’s preferences for the rescheduled service date and time, taking into consideration our team’s availability. 

5. No Additional Charges 

5.1 There will be no additional charges to the client for rescheduling service due to weather conditions if the decision was made to postpone by CEP. The customer will only be responsible for charges if the postponement/rescheduling is the decision of the customer.

6. Client Agreement 

6.1 By scheduling a service with CEP, clients acknowledge and accept the possibility of rescheduling in the event of adverse weather conditions. 

6.2 Clients agree to cooperate with CEP in the rescheduling process and provide accurate contact information for communication purposes. If unable to reach client to reschedule, after 2 week timeframe, client agrees that CEP may process the payment that was authorized for the quoted work, regardless if services have been completed or not.

7. Contact Information 

For any questions, concerns, or to initiate the rescheduling process due to weather conditions, clients can contact CEP and our team will be happy to assist. 

Using Customer’s Property Water for Pressure Washing Services:

1. Acknowledgment and Consent 

1.1 The client provides their explicit consent for CEP’s use of the property’s water supply for pressure washing. 

2. Responsible Use 

2.1 CEP  commits to using the client’s property water supply responsibly and solely for the purpose of conducting the pressure washing service. 

2.2 All reasonable efforts will be made to minimize water wastage and ensure the efficient use of the water supply during the service. 

3. Water Source Inspection 

3.1 Before commencing the pressure washing service, CEP will inspect the client’s property water source, such as an outdoor tap or hose connection, to ensure its proper functionality. 

3.2 In the event of any pre-existing issues or concerns regarding the water source, the client is encouraged to inform CEP to address any potential limitations or complications. 

4. Client Responsibilities 

4.1 The client is responsible for ensuring that the water source on their property is easily accessible to CEP and is in proper working condition. 

4.2 If any issues arise with the water source or if it becomes unavailable for any reason, the client must promptly inform CEP to seek alternative solutions or reschedule the service if necessary. 

5. Water Usage 

5.1 The amount of water used during the pressure washing service may vary depending on the scope of work and the size of the area being cleaned. 

5.2 The client is responsible for the cost of water usage associated with the pressure washing service, if applicable. 

6. Liability 

6.1 CEP will take reasonable precautions to ensure the safe and responsible use of the client’s property water. However, the client agrees that the Service Provider will not be held liable for any damage or issues related to the water supply on the client’s property. 

7. Payment/Properties on Well:

7.1 Any fees associated with water tanks will be communicated to the client, if applicable, and will be included in the final invoice for the pressure washing service. 

7.2 CEP uses your property water. If home is on a well and water flow is insufficient or well capacity is limited, additional fees may incur to deliver water ($150/tank). This charge covers technician’s time to travel to a nearby hydrant, wait for tank to fill, travel back, re-set up time and county hydrant costs. If technician determines this to be needed for the sake of your well, this will be required to reserve on card before job completion. If job is cancelled by customer in middle of completion by declining to pay water tank delivery fees, card will be charged based on Time & Materials starting with a minimum of $250 and could result in full price of quoted house wash, regardless of job completion.

8. Client Agreement 

8.1 By engaging the services of CEP, the client acknowledges and accepts the terms and conditions outlined in this agreement regarding the use of their property’s water supply for pressure washing. 

 

MOVING ITEMS:

Prior to services, CEP asks that you move any and all items out of the way of areas requested to be washed.

Disclaimer of Responsibility for Damages:

1.By engaging the services of CEP, the Client acknowledges and accepts the following disclaimer of responsibility for damages as an integral part of this agreement.

1.1 CEP will take all reasonable precautions to ensure the safe and efficient provision of pressure washing services. However, the Client acknowledges that pressure washing involves the use of high-pressure equipment and water, which may carry inherent risks.

1.2 CEP disclaims all responsibility for any damages, losses, or injuries, including but not limited to:

a. Damage to property, including but not limited to buildings, vehicles, landscaping, outdoor electronics, security systems, decor, etc, that may result from the pressure washing service or moving items requested to be moved. This includes the rare “fogging” effect that happens to multi pane windows with bad seals. 

b. Injury to persons, including the Client or third parties, that may occur during or as a result of the pressure washing service or moving items requested by Client. 

c. Any indirect, consequential, or incidental damages that may arise from the provision of pressure washing services or moving items requested by Client. This includes water intrusion, non working electrical equipment such as Ring Door Bells or camera security systems. 

d. Wood rot or flooring damages due to improperly installed siding; Improperly sealed,  open or broken window or doors; Improperly installed windows, doors, garages, etc.; Loose shingles or siding and defective construction; unsecured wires; loose or improperly installed gutters, leaders and improper caulking; broken or busted hose bibs and damages that may occur during services; damaged or improperly installed electrical outlets, exterior wiring, light bulbs, etc. 

e. Pre-existing damage including but not limited to any parts of your home such as siding, fascia, roofing, windows, screens, concrete, asphalt, pavers, stonework, brick, tile, decks, fencing, gutters, roofing, door knobs, light fixtures, outdoor electronic such as Ring Door Bells, camera systems, etc. 

2. Pre-Service Inspection:

2.1 Before commencing the pressure washing service, the Client is encouraged to conduct a pre-service inspection of the areas to be cleaned. This includes identifying any delicate or fragile items, surfaces, or materials that require special attention or precautions. 

2.2 The Client is responsible for notifying CEP of any such items or conditions that may affect the pressure washing service.

3. Client’s Property:

3.1 The Client is responsible for securing or removing any items, including but not limited to furniture, decorations, and personal belongings, from the areas to be pressure washed. 

3.2 CEP will not be held responsible for any damage or loss of items left within the service area. 

4. Weather Conditions:

4.1 CEP will make reasonable efforts to schedule the pressure washing service on days with favorable weather conditions. However, CEP will not be held responsible for any adverse effects or damages resulting from weather conditions during or after the service. 

5 Liability Limitation:

5.1 CEP’s liability is limited to the cost of re-cleaning or, at CEP’s discretion, refunding the amount paid for the pressure washing service if it is determined that the service was not performed in accordance with industry standards or the terms outlined in this agreement. 

6. Client Agreement:

6.1 By engaging the services of CEP, the Client acknowledges and accepts the terms and conditions outlined in this agreement, including the disclaimer of responsibility for damages. 

 

Disclaimer for Stain Removal

Standard pressure washing does not include the removal of any of the following: Rust, oil, grease, glue, paint, caulk, concrete, or any other non-organic material from your surfaces. CEP will make every effort to remove stains with general pressure washing, however agreement to services is in no way a guarantee that stains will be removed completely. Additional fees may incur for extensive treatment & more extensive chemicals for certain stain removal attempts.  

 

 

PAYMENT:

For New Construction/HOA/Multi-Family or Commercial (Quoted and scheduled through property managers): An invoice will be submitted when work has been completed and payment is due within 30 days from the invoice date or as agreed upon per individual’s Trade Partner’s contracts.

Residential/Individual homeowners: Payment is due the day of service. CEP will provide a link to authorize payment and hold a valid charge card on file. CEP uses a third party vendor, Atlantic Merchant, to process these authorizations and settlements. Once services have been completed, your card will be submitted for processing and charged the quoted amount. If services are not completed and CEP has tried rescheduling, charges to your card may still apply. Please refer to “Scheduling 6.2”.

 

INCLUSION & DISCLUSIONS:

Residential House Wash: 

House washing includes roofline down to foundation. This will include all siding, windows, gutters, front porch and front steps only. This does NOT include roof washing, interior of screened porches, sidewalks, driveways, decks, patios, chimney portion surpassing roofline, or detached garages.  CEP can provide a separate quote or line item for any of these al la carte items you wish to have completed. This is not an extensive washing of windows or gutters and streaks/water spots may appear on windows after washing. CEP is not responsible for streaks/window spots and encourages you to schedule a window company to clean windows after our services are completed. CEP does offer Gutter Brightening Service which can be requested. This will include scrubbing of your gutters with our in-house cleaning mix to brighten/whiten your gutters. Only available with white gutters. Artillery Fungus removal & Oxidation removal is not included.

Gutter & Downspout Clean Out:

Includes removing leaves and large debris (i.e. sticks, pine cones, gumballs) from gutters and downspouts. With gutter guards in place, gutter and downspout cleaning only covers removing debris from the top of the gutter guards. Disassembly of the gutter, gutter guards or downspouts, to clear clogs, may incur additional charges. Flushing of gutters or downspouts to remove small debris and shingle granules is not included. Flushing of extensions or attachments to the downspouts, such as black corrugated pipe(s) , PVC, or similar, is not included. Leaves and debris will be left in an onsite natural or wooded area but if no such area is available then the leaves and debris will be removed from the property. 

 



  1. CEP does not assume any responsibility for any damage that may occur to the Client’s property as a result of the pressure washing services. CEP shall only be obligated under this agreement, which are a direct result of operator error, gross negligence, or willful misconduct. Damages must be discovered and reported within 3 calendar days of service completion. CEP shall had sole option of repairing or contracting repair work to correct any damages that are a direct result of CEP. 
  2. It is the Client’s responsibility to secure and/or remove any personal property from the area to be cleaned. 
  3. The Client assumes all risks associated with the use of high pressure water and any related equipment. CEP will not be held liable for any injuries sustained on the property during the pressure washing process. 
  4. CEP is not responsible for any damage caused by the use of detergents or other cleaning products. If the Client has allergies or sensitivities to certain products, it is the Client’s responsibility to inform CEP prior to the start of the service. 
  5. By utilizing the services of CEP, the Client releases CEP of any and all liability arising from the use of the services. This disclaimer is intended to protect the interests of Creative Enterprise Powerwashing, LLC and to limit its potential liability. The Client is encouraged to review this disclaimer carefully and to seek legal counsel if necessary. The Client’s use of CEP’s services constitutes acceptance of these terms and conditions.
